Customers are solely responsible for maintaining backups. We do not guarantee backup availability
or data recovery under any circumstances.
7. Service Availability (No SLA Guarantee)
Services are provided on a best-effort basis. We do not guarantee uninterrupted availability
unless explicitly stated in a separate SLA agreement.
8. Limitation of Liability
To the maximum extent permitted by law, GNOME IT SOLUTIONS shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, data, or business opportunities. Total liability shall not exceed the amount paid by the customer for the service.
9. Indemnification
Users agree to indemnify and hold harmless GNOME WEB HOSTING LLP / GNOME IT SOLUTIONS LLC
against any claims, damages, liabilities, or expenses arising from misuse of services.
[2] Legal Compliance (India, EU & USA)
2.1 India Compliance
Compliance required with IT Act 2000, IT Rules 2021, IPC 1860, DPDP Act 2023.
We act as an intermediary and will remove content upon valid legal orders.
2.2 GDPR (EU)
Clients handling EU data must comply with GDPR. We act as a data processor only.
2.3 USA Compliance
Includes DMCA, CFAA, CCPA/CPRA. Violations may result in immediate action.
2.4 Export Control & Sanctions
Services may not be used in violation of international export laws or sanctions
(including OFAC restrictions).
2.5 Law Enforcement Cooperation
We may disclose user data to authorities if legally required.
2.6 KYC & Fraud Prevention
We reserve the right to request identity verification documents. Failure to provide valid documents may result in suspension or termination of services.
2.7 Chargebacks & Payment Disputes
Initiating a chargeback without contacting support may result in immediate account suspension and permanent service restriction.

3.1 Immediate Action
We reserve the right to suspend, terminate, or restrict services without notice in case of violations.
3.2 Refund Policy
Refunds, if applicable, are subject to our refund policy. No refunds will be issued in cases of policy violations, abuse, or suspension due to breach of Terms. Certain services including VPS, Dedicated Servers, and third-party licenses are non-refundable.
3.3 Dispute Resolution
Any disputes arising shall first be resolved through mutual discussion. If unresolved, disputes shall be subject to arbitration under applicable Indian laws. Jurisdiction shall be limited to courts located in West Bengal, India.
3.4 Evidence & Reporting
We may preserve logs and share evidence with law enforcement agencies.

4.1 Force Majeure

[1] Uptime Commitment
We aim to provide 99.9% uptime per calendar month, excluding scheduled maintenance.

Downtime caused by force majeure, cyberattacks, user misconfiguration, or third-party failures is excluded.
[3] Maintenance
Scheduled maintenance may occur with prior notice where possible.
[4] No Guarantee
SLA is a target and not a guaranteed commitment unless explicitly agreed in writing.
Data Processing Agreement (DPA) [v1 03/2026]
[1] Role of Parties
Customers act as Data Controllers, and we act as Data Processors under applicable data protection laws.
[2] Data Handling
We process personal data only as necessary to provide services and in accordance with customer instructions.
[3] Security Measures
We implement appropriate technical and organizational measures to protect data.
[4] Data Subject Rights
We assist customers in fulfilling data subject rights under GDPR where applicable.
Acceptable Use Policy (AUP) [v1 08/2026]
[1] Scope
This Acceptable Use Policy applies to all services, accounts, websites, applications, email, DNS, VoIP traffic, and data hosted on or routed through infrastructure operated by GNOME WEB HOSTING LLP / GNOME IT SOLUTIONS LLC ("Gnome IT"). Use of our services constitutes acceptance of this policy and all related policies on this page.
[2] Prohibited Content
Customers may not host, store, transmit, or link to content that: violates any applicable law or regulation; infringes intellectual property or privacy rights; contains child sexual abuse material (CSAM) or exploitation content; promotes violence, terrorism, or hate crimes; contains fraudulent, deceptive, or misleading schemes; or facilitates illegal gambling, drugs, or weapons where prohibited by law. We reserve the right to determine, at our sole discretion, whether content violates this policy.
[3] Prohibited Activities
Strictly prohibited activities include, without limitation: sending unsolicited bulk email (spam) or SMS; phishing, vishing, smishing, or social-engineering attacks; operating botnets, malware distribution, or command-and-control infrastructure; unauthorized access attempts, credential stuffing, or exploitation of third-party systems; DDoS attacks or participation in denial-of-service activity; cryptocurrency mining without explicit written approval; proxy or VPN services used to conceal abuse; reselling services in violation of plan terms; circumventing suspension, billing, or security controls; and any activity that threatens network integrity or the reputation of Gnome IT.
[4] Email & Messaging
Outbound email and messaging must comply with CAN-SPAM, CASL, GDPR/ePrivacy, India IT Rules, and all applicable anti-spam laws. Customers must maintain valid opt-in records for marketing communications, include working unsubscribe mechanisms, and honor suppression requests. We may suspend or terminate services generating excessive complaints, blacklist listings, or abuse reports.
[5] Enforcement
We may investigate suspected violations, preserve evidence, suspend or terminate services immediately without refund, remove or disable content, block network traffic, and report activity to law enforcement, regulators, or industry abuse networks. Failure to respond to an abuse ticket within the stated timeframe may result in automatic suspension.
[6] Customer Cooperation
Customers must cooperate with abuse investigations, provide truthful information upon request, and remediate violations promptly. Repeated or severe violations may result in permanent account termination and blacklisting from future services.
VoIP & Telecom Compliance Policy [v1 08/2026]
[1] Infrastructure Provider Only
Gnome IT provides hosting infrastructure for VoIP platforms (including VOS3000, Sippy Switch, ViciDial, GoAutoDial, Magnus Billing, and related systems). We are a technology and hosting provider — not a telecommunications carrier, common carrier, or regulated telecom operator. Customers remain solely responsible for lawful use of voice services.
[2] Customer Regulatory Obligations
Customers are solely responsible for compliance with all telecom, privacy, and marketing laws in every jurisdiction where they originate or terminate traffic, including but not limited to: TCPA (USA), TSR/FTC rules, STIR/SHAKEN requirements, Do-Not-Call (DNC) registry rules, TRAI / DOT regulations (India), Ofcom/PECR (UK), GDPR/ePrivacy (EU), and local licensing or numbering requirements. Customers must obtain all required licenses, registrations, and carrier agreements before placing live traffic.
[3] Prohibited Telephony Use
Prohibited telephony activities include: illegal robocalling or autodialing without consent; caller ID spoofing for fraud or deception; traffic pumping, toll fraud, or premium-rate abuse; bypass or SIM-box fraud; harassing, threatening, or obscene calls; dialer campaigns without proper consent records; CNAM/LCR manipulation for fraudulent routing; and any traffic identified by carriers, regulators, or upstream providers as abusive or high-risk.
[4] Dialer & Contact Center Responsibility
Customers using Vicidial, GoAutoDial, or similar platforms are responsible for predictive dialer settings, abandonment rates, DNC scrubbing, consent documentation, agent scripts, call recording laws, and data protection for lead lists. Gnome IT does not monitor call content and assumes no responsibility for campaign compliance.
[5] Traffic Monitoring & Suspension
We and our upstream providers may monitor call volumes, CPS, ASR, ACD, complaint rates, and fraud indicators. We may throttle, block destinations, require deposits, or suspend VoIP services immediately upon suspected fraud, spam calling, or regulatory complaints — with or without prior notice.
[6] Indemnity for Telecom Claims
Customers agree to indemnify and hold harmless Gnome IT from fines, penalties, carrier chargebacks, regulatory actions, third-party claims, and legal costs arising from the customer's telephony operations, routing decisions, or failure to comply with applicable telecom laws.
Liability, Warranties & Disclaimers [v1 08/2026]
[1] Services Provided "As Is"
All services are provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, uptime, accuracy, or uninterrupted availability.
[2] No Guarantee of Results
We do not guarantee website rankings, email deliverability, call completion rates, billing accuracy of third-party VoIP platforms, compatibility with all software, or suitability for any specific business purpose. Configuration, security hardening, and application management remain the customer's responsibility unless a separate managed services agreement is signed in writing.
[3] Limitation of Liability
To the maximum extent permitted by applicable law, Gnome IT shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, data, goodwill, business interruption, or replacement costs — even if advised of the possibility of such damages. Our total aggregate liability for any claim arising from or related to the services shall not exceed the amount paid by the customer for the specific service giving rise to the claim during the three (3) months immediately preceding the event, or one hundred U.S. dollars (USD $100), whichever is greater.
[4] Third-Party Services
We are not responsible for failures, outages, or acts of third parties including data centers, network providers, registrars, certificate authorities, payment processors, software vendors, licensing authorities, or upstream carriers. Outages, IP blocks, port blocks, or route changes imposed by third parties do not create liability on the part of Gnome IT.
[5] Security Disclaimer
While we implement reasonable security measures, no system is completely secure. Customers are responsible for strong passwords, patch management, firewall configuration, application security, and protecting their credentials. We are not liable for unauthorized access resulting from customer negligence, weak passwords, or unpatched software.
[6] Data Loss
Customers are solely responsible for maintaining independent backups of all data, configurations, databases, and billing records. Gnome IT is not liable for data loss, corruption, or failed restores, whether or not backup services were offered or attempted.
Refund & Billing Policy [v1 08/2026]
[1] Prepaid Services
All services are billed in advance unless otherwise stated. Activation, provisioning, licensing, IP allocation, and resource reservation may begin immediately upon order acceptance. Setup fees, domain registrations, SSL certificates, and software licenses are generally non-refundable once issued.
[2] Non-Refundable Services
The following are non-refundable except where required by mandatory law: Cloud VPS, VDS, dedicated servers, unmetered servers, VoIP softswitch hosting, dialer hosting, Windows licenses, IP address fees, bandwidth overages, add-on modules, and any service suspended for policy violations or abuse.
[3] Shared Hosting Refunds
Shared and reseller hosting plans may qualify for a refund within thirty (30) days of initial purchase if no Acceptable Use Policy violation has occurred, subject to a processing fee where applicable. Renewal payments and plan upgrades are non-refundable.
[4] Chargebacks & Payment Disputes
Customers agree to contact billing support before initiating a chargeback or payment dispute. Unauthorized chargebacks may result in immediate suspension, collection action, permanent account termination, and recovery of fees, chargeback penalties, and administrative costs.
[5] Taxes & Currency
Prices exclude applicable taxes, duties, and government fees unless stated otherwise. Customers are responsible for all taxes associated with their purchase. Currency conversion and bank fees charged by payment providers are the customer's responsibility.
[6] Billing Errors
We reserve the right to correct billing errors and adjust invoices retroactively. Undercharges may be billed to the customer; overcharges will be credited or refunded at our discretion.
Additional Legal Protections [v1 08/2026]
[1] Entire Agreement
These policies, together with the order form, service descriptions, and any written addendum signed by Gnome IT, constitute the entire agreement between the customer and Gnome IT and supersede prior oral or written communications. No employee or support agent may modify these terms verbally.
[2] Severability
If any provision of these policies is held invalid or unenforceable, the remaining provisions shall remain in full force and effect. Invalid provisions shall be replaced with enforceable terms that most closely reflect the original intent.
[3] No Waiver
Failure to enforce any provision at any time does not constitute a waiver of that provision or any other rights. All waivers must be in writing signed by an authorized representative of Gnome IT.
[4] Assignment
Customers may not assign, transfer, or sublicense their account or services without prior written consent. Gnome IT may assign its rights and obligations in connection with a merger, acquisition, restructuring, or sale of assets.
[5] Class Action & Jury Trial Waiver
To the extent permitted by law, customers agree that disputes will be resolved on an individual basis only and waive any right to participate in a class action, collective action, or representative proceeding. Where permitted, both parties waive the right to a jury trial.
[6] Account Suspension & Termination
We may suspend or terminate accounts immediately for non-payment, policy violations, fraud, chargebacks, legal orders, or risk to our network. Upon termination, access to data may be disabled. Customers are responsible for exporting data before termination. We may delete data after a reasonable retention period following suspension.
[7] Intellectual Property
All Gnome IT trademarks, branding, website content, control panels, and proprietary tooling remain our exclusive property. Customers receive a limited, non-exclusive, non-transferable license to use services for lawful purposes during the paid term only.
[8] Survival
Provisions that by their nature should survive termination — including payment obligations, acceptable use, indemnification, limitation of liability, dispute resolution, and confidentiality — shall survive suspension or termination of services.
